BhariBachat provides a group buying and selling platform to individuals and businesses. BhariBachat.com is owned and operated by Shooting Star Group herein after “SSG”; a partnership firm in India.

We would like to ensure that our customers get a quality experience. We reserve the right to suspend or cancel customer’s access to any of our services, if the account has been inappropriately used or in the event that the use of an account is adversely affecting the service level provided to our customers as a whole.

We are a start-up company and therefore constantly evolving; we reserve the right to change our Terms and Conditions when necessary. It is the subscriber’s responsibility to ensure that they are up to date with our Terms and Conditions. However, we will notify customers of any important changes we feel they need to be aware of. By signing up to any of our services, customers agree to be bound to all of our Terms and Conditions.

The Terms and Conditions are outlined below and apply to all users of this domain; BhariBachat.com and all sub-domains related to BhariBachat and domains owned by ‘SSG’. If you have any enquiries please do not hesitate to contact us.

Registration

To register for the BhariBachat service (‘The Service’) you must enter your name and e-mail on the homepage. During registration you will be asked for certain personal information so that an account can be created for your sole use. Your account is not transferable and will not be shared with any other company or individual.

You must ensure that the personal information in your account is correct, and is updated by you as necessary. This can be done at any time from the ‘My Account’ tab on the home page. There is more detail of the protection of your personal data in our Privacy Policy, which describes the data we collect, the purposes of use and our rights of transfer.

Obligations

You agree and undertake to use the Website only to post and upload material that is proper. By way of example, and not as a limitation, you agree and undertake that when using the Website, you will not:

• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information through any bookmark, tag or keyword;
• Upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents;
• Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another’s computer;
• Conduct or forward surveys, contests, pyramid schemes or chain letters;
• Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner;

• Notwithstanding anything to contrary, SSG’s entire liability to you shall be the refund of the money charged from you for any specific Voucher, under which the unlikely liability arises. Under no circumstance shall SSG be liable for any consequential, indirect or remote loss that you or your friends and family may suffer.

  Conduct

• You shall solely be responsible for maintaining the necessary computer equipments and Internet connections that may be required to access, use and transact on the Website.
• You are also under an obligation to use this Website for reasonable and lawful purposes only, and shall not indulge in any activity that is not envisaged through the Website.
• You shall use this Website, and any voucher/coupons purchased through it, for personal, non-commercial use only and shall not re-sell the same to any other person.

Service

The Service allows you to make an offer to buy a voucher for goods or services on the terms shown on the site. Following confirmation of payment, a binding contract is established between you and SSG for the voucher.

The contract for the purchase of the voucher is between you and SSG, whereas the contract in relation to the supply of goods and/or services (‘The Deal’) is between you and the third parties offering those goods and/or services (‘The Merchant’). Any queries or concerns relating to the Deal should be addressed to the Merchant. You will see the name, address and contact details of the Merchant in the voucher.

Vouchers

The vouchers we supply through the service are evidence of payment for, and your entitlement to, the goods or services in question. Each voucher carries a unique serial number, which must be quoted when dealing with SSG or the Merchant. Vouchers and their associated references must be kept safely and securely. The voucher should be taken on the day when you wish to collect the goods or use the service in question, and must be surrendered to the Merchant or alternatively sent to the Merchant if requested to secure the booking. Once a voucher has been issued it cannot be exchanged or refunded NOTE: this does not affect your statutory rights.

Availability

All offers for vouchers are also subject to availability of the goods or services in question, which is outside our control. If an offer for a voucher cannot be fulfilled for any reason, SSG will promptly refund all monies paid. SSG reserves the right to undertake security checks and, if necessary, delay dispatch of the voucher.

Validity Period

The Voucher is generally valid for a period of up to 3 months from date of purchase unless otherwise stated on the Deal page and voucher. After the expiry date shown on the voucher it will be deemed to be invalid. No liability will be accepted by either SSG or the Merchant.

Payment Details

You accept financial responsibility for all transactions made under your name or account.

The purchase of a voucher by you will constitute consent to pass your credit or debit card to our payment processing provider. You undertake to us that the details you give us of your credit or debit card are correct, that the credit or debit card belongs to you and that there are sufficient funds to cover the price of the voucher. If there are any changes in your payment details it is your responsibility to inform us at support@bharibachat.com. Failure to supply the correct credit or debit card, billing address information and/or cardholder details may result in delay to the issue of your voucher. We also reserve the right to cancel vouchers if payment is declined or the incorrect cardholder and/or billing address have been supplied.

Deal Restrictions

Vouchers are subject to restrictions which are detailed in the Fine Print. These restrictions are imposed by the Merchant and not by SSG. By making a purchase you have confirmed that you have checked and accepted all of these, without exception. Details of these restrictions will be available on the deal and contained in the voucher.

Vouchers as a Gift

If you buy a voucher as a gift for someone else, it is your responsibility to ensure that you purchase a gift voucher appropriate for the intended recipient and to double check that the restrictions are not prohibitive to them. If you are unsure of the suitability of any specific voucher then we recommend that you refer them to the Deal rather than make a purchase on their behalf.

Deal Description

Description of goods and services given in the Deal including details, format, conditions and restrictions are intended only to present an indication and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and SSG. SSG offers products and services from a wide number of Merchants and therefore cannot be held responsible for detailed description on the deal or the website of any Merchant or other third party.

Sales Tax (GST)

Unless specified otherwise, prices shown include sales Tax (GST). This has been added at the rates applicable on the day of purchase of the voucher.

Voucher Cancellation

SSG will provide a refund of the purchase price paid by you for any Deal within five days after the purchase of a voucher, provided that the voucher has not yet been redeemed. After five days, we do not provide refunds except that we will provide a refund if you are unable to redeem a voucher before the applicable expiration of the voucher because the relevant Merchant has gone out of business.

Any request for cancellation of a BhariBachat voucher must be submitted by email to support@bharibachat.com where your request will be actioned promptly.

Resale of Vouchers

You may not re-sell the Service without the prior written consent of SSG.

Availability of the Service

We reserve the right to suspend the site at any time for operational, regulatory, legal or other reasons. There is no guarantee that the Site will be available at all times without interruption. Although we make reasonable attempts to ensure the Site is available, bug and virus free. We retain the right to terminate without notice your use of the Site with immediate effect if you breach any of these Terms.

Monitoring

SSG shall have the right, but not the obligation, to monitor the content of the Site at all times, including any chat rooms and forums that may hereinafter be included as part of the Site, to determine compliance with this Terms and Conditions and any operating rules established by SSG, as well as to satisfy any applicable law, regulation or authorised government request. Without limitation, SSG shall have the right to remove any material that in its sole discretion, finds to be in violation of the provisions hereof.

Privacy

The user acknowledges that all discussion for ratings, comments, bulletin board service, chat rooms and/or other message or communication facilities (collectively “Communities”) are public and not private communications, and that, therefore, others may read end user’s communications without end user’s knowledge. SSG does not control or endorse the content, messages or information found in any Community, and, therefore SSG specifically disclaims any liability concerning the Communities and any actions resulting from end users participation in any Community, including any objectionable content. Generally, any communication which end user posts to SSG (whether in chat rooms, discussion groups, message boards or otherwise) is considered to be non-confidential. If particular web pages permit the submission of communications that will be treated by SSG as confidential, that fact will be stated on those pages. By posting comments, messages or other information on the Site, end user grants SSG the right to use such comments, messages or information for promotions, advertising, market research or any other lawful purpose. The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of SSG in respect of the Website. You further consent that the terms and contents of such Privacy Policy are acceptable to you.

Termination

SSG may terminate this Agreement at any time. Without limiting the foregoing, SSG shall have the right to immediately terminate any passwords or accounts of User in the event of any conduct by User which SSG, in its sole discretion, considers to be unacceptable, or in the event of any breach by User of this Agreement. All such provisions wherein the context so requires including Sections10, 11, 14, 15 & 16 will survive termination of this Agreement.

Intellectual Property

Except as expressly permitted by these Terms and Conditions or as otherwise agreed with us, you may not copy, disseminate, or download any content of the Site or other Intellectual Property of SSG.

Liability

SSG warrants that it has the right to provide the Service and will use all reasonable skill and care in making the Service available and in ensuring its availability, but the Site is provided as it currently is and we do not guarantee that the Site will meet your expectations or requirements.

The Site is accessed via the internet and is solely at your own risk and subject to all applicable local, national and international laws and regulations. We do not represent that the Site is appropriate or available for use in any jurisdiction other than the India. We have no control over and assume no responsibility for any content provided within the Site by third parties and we accept no responsibility for any loss or damage that may arise as a result of you accessing third party content. If you choose to access any of the third party websites linked to the Site, you do so entirely at your own risk.

While we take all reasonable steps to ensure the security of the Site, SSG cannot accept responsibility for any loss you may incur as a result of theft, impersonation or identity fraud. We shall not under any circumstances be liable for any unforeseeable loss or any business loss, including loss of profit, which results from the use of, or your inability to use, the Site or the Service.

Nothing contained in these Terms and Conditions is intended to limit or exclude any liability for death or personal injury arising from negligence, or for fraudulent misrepresentation, or any other liability which may not be excluded by law.

Force Majeure

Without prejudice to any other provision herein, SSG shall not be liable for any loss, damage or penalty as a result of any delay in or failure to deliver or otherwise perform hereunder due to any cause beyond the SSG’s control, including, without limitation, acts of the User, embargo or other governmental act, regulation or request affecting the conduct of SSG’s business, fire, explosion, accident, theft, vandalism, riot, acts of war, strikes or other labour difficulties, lightning, flood, windstorm or other acts of God.

General

These Terms and Conditions are governed by India, English Law and you agree to submit to the non-exclusive jurisdiction of the courts at Mumbai, India. If any provision of these Terms and Conditions is held to be unlawful, invalid or unenforceable, by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions contained in these Terms and Conditions and the remaining portions shall continue in full force and effect.

We reserve the right to change these Terms and Conditions from time to time without prior notice. Any change will become effective immediately upon posting to the Site. By continuing to use the Site, you will be deemed to accept any such change.
